Family law is an umbrella term used in legal issues to cover all family related issues and domestic relations. Spousal abuse, legitmacy, surrogacy, child abuse and abduction, divorce, paternity fraud and testing, alluments, property settlements, parental rights and responsibilities and prenuptual agreements would all be covered under family court’s purview.

When entering into a marriage or civil union, you may decide you want a prenuptial agreement with your perspective spouse that will outline how martial assets are divided should a marriage terminate. Prenuptial agreements are sometimes not recognized by the courts which is why it’s very important to have a lawyer involved in the proceedings.

Divorce is often a very emotional time because of the dissolution of the marriage and the amount of paperwork involved in a child custody agreement and property agreement even when both parties are in agreement are very difficult to navigate, let alone when there is disagreement. A lawyer will see to the legal aspects of the case.

Any issue dealing with your children and any issue dealing with abuse is also going to be very emotionally charged and difficult to proceed with simply on an intuitive level and working with the courts only compounds the visceral issues at hand. Sorting through both paperwork and psychological issues are too much for just about anyone to manage which is why it’s vital to have a lawyer involved to take care of the court aspect while you are taking care of yourself and your children.

As choosing a law firm to represent your interest in family law is so important, Hillman, Brown & Darrow Law Firm will ensure that your interest will be best represented. Known for their impeccable attention to detail and their understanding of clients’ needs, the law firm of Hillman, Brown & Darrow (P.A.) is a historic and prestigious Annapolis law firm that began in 1929 when it was founded by Noah A. Hillman. In 1976, the firm was joined by Samuel J. Brown and then in 1979 the firm merged with Michael P. Darrow’s practice, making HBD complete.

Family law is defined as an area of the law that primarily deals with issues concerning domestic relations and family. This can include marriages, civil unions, and domestic partnerships and the issues of spousal abuse, adoption, child abuse, child abduction, and legitimacy. Family courts will also deal with the termination of the relationship or divorce and the proceedings surrounding it. During these ancillary matters, annulment, property settlements, divorce, alimony, child support, and parental responsibilities are discussed and ruled.

If you are looking to gain custody of a child or you are going to be dealing with a divorce, it would be suggested that you get a family law lawyer who is experienced in these matters. A lawyer will know the ins and outs of the business and make getting a favorable judgment easier than if you are to tackle the situation alone. A lawyer can aid you in the paperwork process and negotiate any type matters legally. Family law lawyers that specialize in divorce can help negotiate asset division and custody issues. It is suggested that you use a family law lawyer to mediate any discussions to prevent any legal liabilities within the court. In addition, to paperwork, a family law lawyer can alleviate the stress of dealing with a divorce. A lawyer can easily answer any questions you may have about the proceedings and walk you through the court process. Child custody can also be resolved through mediation with all parties with your lawyers present.

Once both parties have come to a compromise, your lawyer will be able to execute all decisions that are made and will keep in contact with you until everything is done. A family law lawyer can make the process of family law a lot easier for everyone that is involved and reduce the amount of stress necessary to get through this difficult time. Remember, a family law lawyer’s job is to make your life easier and iron out the details of any legal case. Do not be afraid to ask as many questions as possible to gain a better understanding of your situation.

Maintaining stability for children during divorce actions is important. Sometimes children become pawns and one parent uses the children against the other to gain leverage in negotiations for property, money or just to “get even”. If a parent tries to turn the children against the other parent quick action is necessary. There are simple things to watch for:

1. Child doesn’t take your calls, emails or texts.
2. Refuses to have visitation or ignores you and treats you as if you don’t exist.
3, Remove their Facebook or MySpace pages or deletes you as a friend.
4. Doesn’t provide you with information from school or activities.

When you see these signs you must react.

1. Spend more time with the child and have a 3rd party witness the interaction.
2. Go to their school and keep in touch with their teachers.
3. Become involved in their school, religious and extracurricular activities
4. Get a reference for a good counselor
5. Seek legal advice.

If you catch it early enough you can stop the poisonous attitude from flowing into the child and out to you. Sometimes it is too late and you need court intervention. If so you need to get a good counselor who can help with reunification and isn’t afraid to take a stand and an attorney who understands issues of alienation. You can file suit for interference with visitation rights. Ask for money damages from the other parent. Sometimes the poison stops flowing when it can cost one parent money.

Loss of affection and respect from a child is a heart breaking experience. A non-custodial parent must be diligent and spend time becoming acquainted with every aspect of their child’s life. Don’t be afraid to become a part of your child’s life. Meet their teachers; meet their doctors; show up at events. Just because your child is not with you doesn’t mean that you stop being a parent. A child needs two parents and should never feel isolated or abandoned. Be proactive and not reactive. You child deserves the best.
